What is a trademark, and why should I register it in the UAE?
1. What is a Trademark? A trademark is a recognizable sign, design, or expression (like a name, logo, word, or signature) that distinguishes the products or services of one source from those of others.

2. Why Register? Although not legally compulsory, registration grants you exclusive legal rights to use the mark across all seven Emirates (Abu Dhabi, Dubai, etc.). This provides a legal presumption of ownership, allowing you to take action against infringement (unauthorized use) and enhancing your brand's credibility and value as a business asset.
Which authority is responsible for trademark registration in the UAE?
The official authority is the Ministry of Economy (MOE) – Trademark Department.
What documents are typically required for filing a trademark application?
The main required documents generally include:

1. A clear, digital copy of the trademark/logo (usually in JPEG format).

2. A copy of the applicant's Trade License (for a company).

3. A copy of the applicant's Passport/Emirates ID.

4. A Notarized Power of Attorney (if filing through a legal agent).

5. A detailed description of the goods/services and their corresponding Nice Classification class(es).
What is Copyright and what does it protect in the UAE?
1. What it is: Copyright is the legal right granted to the creator (the author) of an original work of authorship. It gives the owner exclusive rights to copy, distribute, perform, display, or adapt their work.


2. What it protects (under Federal Law No. 38 of 2021): The protection covers works in the fields of literature, art, and science, provided they are original. This includes, but is not limited to:

2.1 Literary Works: Books, articles, poems, lectures, computer programs, and databases.

2.2 Artistic Works: Paintings, drawings, sculptures, architectural designs, and photographs.

2.3 Musical Works: Compositions, with or without lyrics.

2.4 Audio-Visual Works: Films, videos, and smart applications.
What are the two main types of company setups in the UAE?
1. Mainland: Licensed by the local Department of Economy and Tourism (DED). Allows you to trade freely anywhere in the UAE.

2. Free Zone: Licensed by a specific Free Zone Authority (e.g., DMCC, JAFZA). Primarily for international trade and can only sell into the Mainland through an agent/distributor.
